These Terms and Conditions govern your enrolment in and use of courses and programmes offered by Mindforge, operating from Suite 8-A, Jalan Tun Mustapha, 88000 Kota Kinabalu, Sabah, Malaysia. By enrolling in any Mindforge course or using this website, you agree to be bound by these terms. Please read them carefully before proceeding.
1. Definitions
In these Terms and Conditions, the following words carry the meanings set out below:
- "Mindforge" / "We" / "Us" / "Our" refers to the business operating under the name Mindforge from Suite 8-A, Jalan Tun Mustapha, 88000 Kota Kinabalu, Sabah.
- "Course" / "Programme" means any structured educational offering made available by Mindforge, including the Hands-On Machine Learning Course, Applied AI Engineering Block, and Forge Capstone Programme.
- "Participant" / "User" / "You" means any individual who enrols in a Course, accesses course materials, or uses this website.
- "Content" means all materials, notes, recorded sessions, practice notebooks, written feedback, and other resources made available as part of a Course.
- "Agreement" means these Terms and Conditions together with any enrolment confirmation issued by Mindforge.
- "Website" means the Mindforge website accessible at https://mindforgesiasd.world.
2. Acceptance of Terms
By submitting an enrolment enquiry, making a payment, or accessing any course material, you confirm that you have read, understood, and agree to be bound by this Agreement.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in Malaysia. If you are enrolling on behalf of an employer or other organisation, you represent that you have the authority to bind that organisation.
If you do not agree to these terms, you should not enrol in any Mindforge course or use this website.
3. Service Description
Mindforge provides educational courses in AI programming and engineering, delivered in Kota Kinabalu, Sabah. Current offerings include:
- Hands-On Machine Learning Course (10 weeks, RM 510)
- Applied AI Engineering Block (12 weeks, RM 1,520)
- Forge Capstone Programme (16 weeks, RM 2,960)
Courses are delivered through a combination of recorded lectures, live online or in-person coding sessions, and self-paced practice notebooks. Course schedules and formats may vary by cohort. Details of each cohort are confirmed at the time of enrolment.
Mindforge reserves the right to modify course content, format, schedule, or delivery method at any time, provided that material changes are communicated to enrolled participants in advance. Courses are educational in nature; they do not lead to formally accredited qualifications.
4. Enrolment and Accounts
Enrolment is confirmed upon receipt of full payment and written confirmation from Mindforge. Submission of an enquiry form does not constitute enrolment.
Access to course materials may be provided through a participant account or shared communication channel. You are responsible for keeping any access credentials secure and for all activity under your account. You must notify Mindforge promptly if you believe your access has been compromised.
Access to course materials is provided for the duration of the course only, unless otherwise stated in writing. Mindforge may withdraw access upon termination of the Agreement in accordance with Section 12.
5. User Responsibilities
As a participant, you agree to:
- Engage with course materials and sessions in good faith and for personal educational purposes only.
- Submit practice notebooks and project work that represents your own effort. Submitting work that is not your own is a breach of this Agreement.
- Treat other participants, instructors, and mentors with respect during all sessions and communications.
- Not record, distribute, or reproduce live session recordings or course materials without prior written consent from Mindforge.
- Not share your course access credentials with others.
- Not use course materials for any commercial purpose, including resale, redistribution, or incorporation into other training products.
Mindforge reserves the right to remove any participant from a course, without refund, where conduct is found to be disruptive, dishonest, or in breach of these terms.
6. Intellectual Property
All course Content — including recorded lectures, written materials, practice notebooks, and feedback — is the intellectual property of Mindforge and is protected under Malaysian copyright law and applicable international conventions.
Mindforge grants you a limited, non-exclusive, non-transferable licence to access and use the Content for your personal educational purposes during the course period. This licence does not transfer ownership to you and does not extend to reproduction, redistribution, or commercial use of any kind.
Work you produce independently as part of the course — including your practice notebooks and capstone project — remains your own. By submitting such work, you grant Mindforge a non-exclusive licence to review it and provide feedback.
7. Payment Terms
All fees are quoted and payable in Malaysian Ringgit (RM). Current course fees are:
- Hands-On Machine Learning Course: RM 510
- Applied AI Engineering Block: RM 1,520
- Forge Capstone Programme: RM 2,960
Payment in full is required to confirm enrolment unless a written payment arrangement has been agreed with Mindforge in advance. Accepted payment methods are confirmed at the time of enrolment.
Cancellation and refund policy: If you cancel your enrolment more than 14 calendar days before the course start date, you are entitled to a full refund less any bank or transfer charges. Cancellations made 14 days or fewer before the start date are not entitled to a refund. Mindforge may, at its discretion, offer a credit toward a future cohort in lieu of a refund. Where Mindforge cancels a cohort, enrolled participants will receive a full refund.
Fees may be revised between cohorts. The fee applicable to your enrolment is the one confirmed in your enrolment communication.
8. Course-Specific Terms
Completion records: A course completion record is issued on submission of all required practice notebooks or project deliverables, as applicable to each course. The completion record confirms participation and submission; it is not a formal academic qualification and does not carry credit recognition under any Malaysian educational framework.
Prerequisites: Enrolment in the Applied AI Engineering Block and Forge Capstone Programme is subject to Mindforge's assessment of your stated experience. If your background does not meet the stated prerequisites, Mindforge may decline or defer your enrolment.
Attendance and engagement: Courses are structured around weekly sessions and practice submissions. There is no mandatory attendance requirement for live sessions, provided you engage with recordings and submit the required work on schedule. Mindforge may, at its discretion, decline to issue a completion record where submission requirements have not been met.
Academic integrity: All submitted work must be your own. Where Mindforge reasonably determines that submitted work was not produced by the participant, the enrolment may be terminated without refund and no completion record will be issued.
9. Disclaimers
Courses are provided on an "as available" basis for educational purposes. Mindforge does not represent that participation in any course will lead to any particular employment outcome, professional qualification, or level of technical proficiency. Outcomes depend on the participant's own effort, prior experience, and circumstances.
Course content reflects the state of the relevant technology and practices at the time of delivery. The field of AI and machine learning changes rapidly; Mindforge does not represent that course content will remain current beyond the cohort in which it is delivered.
Nothing in these terms or in any course material constitutes professional advice of any kind, including career, financial, or legal advice.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Mindforge's total liability to you for any claim arising from or related to these terms or any course shall not exceed the amount you paid for that course.
Mindforge shall not be liable for any indirect, incidental, consequential, or special loss or damage — including loss of income, loss of data, or loss of opportunity — whether arising from contract, tort, or otherwise, even if Mindforge has been advised of the possibility of such loss.
Nothing in these terms excludes or limits Mindforge's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law under the Consumer Protection Act 1999 (Malaysia) or other applicable legislation.
Mindforge shall not be held liable for delays or failures in performance resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, telecommunications disruptions, governmental actions, or public health emergencies.
11. Indemnification
You agree to indemnify and hold harmless Mindforge, its instructors, mentors, and staff from and against any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of this Agreement, your misuse of course materials, or any conduct that causes harm to other participants or to Mindforge.
12. Termination
You may withdraw from a course at any time by notifying Mindforge in writing. Refund eligibility is governed by Section 7.
Mindforge may terminate your enrolment immediately and without refund if you breach any material term of this Agreement, including but not limited to violations of the academic integrity or intellectual property provisions.
Upon termination, your access to course materials will be withdrawn. Sections 5 (User Responsibilities), 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Dispute Resolution) survive termination.
13. Dispute Resolution
This Agreement is governed by the laws of Malaysia. Any dispute arising from or in connection with this Agreement shall first be referred to good-faith negotiation between the parties. If the dispute is not resolved within 30 days of written notice, either party may refer the matter to mediation under the rules of the Malaysian Mediation Centre before pursuing any other remedy.
If mediation does not resolve the dispute, the parties submit to the exclusive jurisdiction of the courts of Sabah, Malaysia.
Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
14. General Provisions
Entire agreement: This Agreement constitutes the entire agreement between you and Mindforge with respect to your enrolment and supersedes any prior representations or understandings.
Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force and effect.
Waiver: Mindforge's failure to enforce any provision of this Agreement on one occasion does not constitute a waiver of the right to enforce it on another.
Assignment: You may not assign your rights or obligations under this Agreement without Mindforge's prior written consent. Mindforge may assign its rights and obligations, for example in connection with a business transfer, provided that your rights as a participant are not materially affected.
Notices: Notices from you to Mindforge should be sent to [email protected]. Mindforge will communicate with you using the email address provided at enrolment.
15. Changes to Terms
Mindforge may update these Terms and Conditions from time to time. When changes are made, the updated version will be published on this page with a revised "Last Updated" date. Where changes are material, Mindforge will notify enrolled participants by email at least 14 days before the changes take effect.
Your continued use of the website or participation in a course after the effective date of any change constitutes acceptance of the revised terms. If you do not agree to the revised terms, you should contact Mindforge to discuss your options before the effective date.
